1. About EZvest and these terms

EZvest is currently an unincorporated online service operated from South Africa under the trading name "EZvest". In these terms, "EZvest", "we", and "us" mean the individual operator trading as EZvest. These terms form the agreement between you and that operator for use of the service. 2. Acceptance

When you create an account, including through Google, you must actively tick the relevant box confirming that you agree to these terms and acknowledge the Privacy Policy. We record the acceptance time and legal-document version with the account. You may browse any public page that does not require acceptance, but you must not use account or paid features if you do not agree. If you use EZvest for an organisation, you confirm that you are authorised to bind it.

3. What EZvest provides

EZvest provides market information, news, watchlists, portfolio tracking, price alerts, learning tools, saved reports, AI-assisted analysis through FinBot, and subscription plans with monthly FinBot credits. Features may change as the product develops.

4. No financial advice

EZvest is an information and research tool. EZvest, FinBot, market summaries, watchlists, alerts, portfolio metrics, and saved reports do not constitute financial, investment, tax, accounting, legal, or other professional advice. We are not your financial adviser, broker, exchange, portfolio manager, financial services provider, bank, or tax adviser unless expressly stated in a separate signed agreement.

You are responsible for your own decisions. Before buying, selling, holding, or otherwise dealing in any investment, consult a licensed financial adviser or registered investment professional who understands your circumstances. Past performance is not a guarantee of future performance. All investments carry risk, including possible loss of capital.

5. AI, reports, and market information

AI-generated content can be wrong, incomplete, delayed, biased, or unsuitable for your circumstances. FinBot responses may be generated by a third-party AI provider using the prompt and context described in the Privacy Policy. A report may summarise sources and user inputs, but internal system prompts, security controls, provider configuration, and proprietary processing details are not part of the report.

Market prices, charts, news, calendar events, company data, calculations, and evidence may be delayed, inaccurate, unavailable, or supplied by third parties outside our control. Displayed prices are indicative and are not executable quotes. EZvest does not execute orders or hold investments or client money. Verify important information with an authorised broker, issuer, exchange, regulator, or professional before acting.

6. Eligibility

You must be at least 18 years old and legally able to enter into these terms. You may not use EZvest if doing so would breach laws that apply to you.

7. Your account

You must provide accurate account information and keep it updated. You may authenticate using an available email method or an enabled third-party identity provider such as Google. Your use of a third-party identity provider is also subject to that provider's terms and privacy practices. You are responsible for protecting your device, email or connected identity account, password or login codes, and active sessions, and for activity under your account unless applicable law provides otherwise. Notify us promptly if you suspect unauthorised access. We may require verification before account, billing, export, or deletion actions.

You keep ownership of information you submit, such as portfolio entries, watchlists, prompts, notes, and settings. You grant us a limited, non-exclusive, worldwide licence to host, process, transmit, reproduce, display, and back up that content only as reasonably necessary to provide, secure, maintain, troubleshoot, and support EZvest, comply with law, and exercise our rights under these terms. This licence ends when the content is deleted from active systems, subject to reasonable backup cycles and legal retention.

AI output may not be unique, and another user may receive similar output. As between you and EZvest, and to the extent permitted by law and our provider terms, you may use output generated specifically for you. You are responsible for checking it before use and for respecting third-party rights.

You warrant that you have the right to submit the information you provide and that it is accurate enough for your intended use. We may remove content or restrict access where reasonably necessary for security, legal compliance, or abuse prevention.

10. Plans, credits, prices, and billing

EZvest may offer free plans, recurring paid plans, and one-time credit bundles. The app identifies the plan or bundle, included features or credits, billing period, price, and currency before you start checkout. Any tax that must be charged will be included in the displayed total or disclosed before you confirm payment. Paid subscriptions are billed monthly through Payfast unless the checkout says otherwise. A recurring subscription authorises Payfast to charge the selected payment method on each renewal date until cancellation.

FinBot credits are limited, revocable service-use units, not money, stored value, securities, or property. Monthly plan credits are allocated and may reset on the schedule shown for the plan. Unless checkout states otherwise, unused monthly credits do not roll over. Top-up credits are governed by the expiry information shown at purchase. Credits cannot be transferred, resold, or redeemed for cash, except for a refund required by law. We may reverse credits allocated because of payment reversal, fraud, abuse, or obvious error.

We may change prices or plan features prospectively. We will give advance notice required by law before a recurring price increase takes effect and, where required, obtain renewed consent. A change will not alter a completed one-time purchase.

11. Payment provider

Payments are processed by Payfast and its payment partners. Your use of Payfast checkout may be subject to Payfast's terms and privacy notices. We do not intentionally collect or store full card numbers in EZvest.

12. Renewal, cancellation, withdrawal, and refunds

Paid subscriptions renew automatically until cancelled. You can cancel in the Plan & Credits section of Settings or request help at support@ezvest.co.za. Review the confirmation carefully: under the current cancellation flow, cancellation stops future charges and may return the account to the free plan immediately. Cancellation does not automatically refund a completed charge, but this does not limit any statutory refund, cooling-off, withdrawal, chargeback, or service-remedy right.

South Africa: if an agreement resulted from direct marketing and the Consumer Protection Act gives you a cooling-off right, you may cancel within five business days after the later event specified by that Act. We will handle cancellation and refund timing as required by law. Other rights may apply if the service is defective, not as described, or not supplied as agreed.

European Economic Area: a consumer may generally withdraw from a distance service contract within 14 days. If you expressly request supply during that period, you may owe a proportionate amount for service supplied before withdrawal; for digital content, the withdrawal right may be lost once supply begins only where the legally required express consent and acknowledgment were obtained. Contact support to exercise the right. Mandatory national variations remain applicable.

United States and Canada: cancellation, renewal, refund, and service-remedy rights required by federal, state, provincial, or territorial law continue to apply. Nothing here makes a lawful refund or cancellation process more difficult than the law permits.

13. Electronic communications

You agree to receive account, authentication, security, billing, product-operation, and support communications electronically through the app or email. Electronic records and signatures may satisfy writing requirements where the law allows. Marketing requires any separate consent prescribed by law and includes an unsubscribe method; opting out of marketing does not stop necessary service messages.

14. Service availability

EZvest may be interrupted by maintenance, third-party outages, internet issues, market-data or AI provider problems, payment outages, or security events. We may change, suspend, limit, or discontinue features where reasonably necessary, with notice where required. If a paid feature is permanently withdrawn, mandatory refund, conformity, or termination remedies remain available.

15. Third-party services and links

EZvest may rely on or link to third-party services, websites, APIs, data providers, AI providers, payment providers, and content sources. We do not control third parties and are not responsible for their content, availability, accuracy, policies, or acts except where applicable law says otherwise.

16. Intellectual property

EZvest, FinBot, the app design, logos, text, software, code, workflows, and generated app materials belong to us or our licensors, except for your content and third-party materials. You may use EZvest only as allowed by these terms.

17. Privacy

Our Privacy Policy explains how we process personal information, including FinBot processing, international transfers, retention, and regional privacy rights. Acceptance of these terms is not consent to any processing for which law requires a separate, freely given consent.

18. Warranties and disclaimers

Nothing in these terms excludes a warranty, guarantee, quality standard, digital-content conformity obligation, or remedy that cannot lawfully be excluded. Subject to those rights, EZvest is provided "as is" and "as available". We do not promise uninterrupted access, investment outcomes, market-data or AI accuracy, compatibility with every device, or that every feature will meet your particular expectations.

19. Limitation of liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability where applicable for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of data-protection duties, or mandatory consumer rights.

Subject to that sentence and to the fullest extent permitted by law, EZvest is not liable for indirect, consequential, special, exemplary, or punitive loss; loss of profit, opportunity, goodwill, or data; or investment and trading loss caused by a decision made in reliance on informational or AI content. Where liability may lawfully be limited, aggregate liability relating to EZvest will not exceed the greater of the amount you paid to EZvest in the 12 months before the event giving rise to the claim or R1,000. This limitation does not reduce a mandatory statutory remedy.

20. Indemnity

To the extent permitted by law, you are responsible for third-party claims and reasonable losses caused by your unlawful commercial use of EZvest, material breach of these terms, infringement of third-party rights, or content you had no right to submit. This does not require a consumer to indemnify EZvest for our negligence, unlawful conduct, breach of these terms, or matters outside the consumer's control.

21. Termination

You may stop using EZvest at any time. You can permanently delete your account and saved EZvest data from the Account section in Settings. Active recurring billing is disabled before account deletion is completed. We may retain transaction, legal, security, fraud-prevention, backup, or dispute records where permitted or required by law. We may suspend or terminate access if you materially breach these terms, create a security or legal risk, fail to pay, or abuse the service. Where practical and lawful, we will give notice and a reasonable opportunity to remedy the issue. Immediate action may be necessary for fraud, security, illegality, or harm. Termination does not affect accrued rights, refunds required by law, or provisions that by their nature should survive.

22. Regional consumer rights

South Africa: these terms do not limit rights under the Consumer Protection Act, Electronic Communications and Transactions Act, POPIA, or another non-excludable law. Required notices, cooling-off rights, fair-contract protections, and remedies prevail over an inconsistent term.

European Economic Area and United Kingdom: mandatory rules on pre-contract information, fair terms, withdrawal, digital-content and digital-service conformity, remedies, and local dispute forums continue to apply. Nothing in these terms deprives you of the protection of mandatory law in the country where you habitually reside.

United States and Canada: non-waivable federal, state, provincial, and territorial consumer, auto-renewal, privacy, accessibility, and digital-service rights continue to apply. Quebec consumers retain any mandatory rights and forum protections available under Quebec law.

23. Complaints, governing law, and disputes

Please contact support@ezvest.co.za first and provide the account email, transaction or feature involved, and requested resolution. We will try to resolve the dispute informally. You may also use a consumer regulator, data-protection authority, ombud, chargeback process, small-claims process, or court where applicable law permits.

These terms are governed by the laws of the Republic of South Africa, and South African courts may hear disputes. If you are a consumer elsewhere, this choice does not deprive you of mandatory protections or a forum that cannot lawfully be waived in your country, state, province, or territory.

24. Changes to these terms

We may update these terms for legal, security, provider, or product changes. We will post the new version and date and give advance, prominent, or direct notice of material changes where required. We will obtain affirmative agreement again where the law or nature of the change requires it. Changes do not retroactively reduce accrued consumer rights.

25. General provisions

If a provision is unlawful or unenforceable, it will be limited to the minimum extent necessary or severed, and the rest will continue. A delay in enforcing a right is not a waiver. You may not assign your account or these terms without our consent; we may assign the agreement as part of a genuine restructuring, financing, merger, acquisition, or sale, subject to notice and mandatory rights. These terms, the Privacy Policy, checkout disclosures, and any feature-specific terms shown to you form the agreement for EZvest. Headings are for convenience only.
